• Payment processing services between users and Contributors
• AI-powered chatbot for general platform information and navigation assistance
• Technical customer support for platform use, downloads, and account management

Legal Kits Pro does NOT:

• Create, author, publish, review, or endorse any legal document kits or their contents
• Provide legal advice, legal services, or attorney-client relationships
• Guarantee the accuracy, completeness, legality, or suitability of any kit
• Practice law or provide legal representation in any jurisdiction

3. No Attorney-Client Relationship

Contributors are Independent. Each legal document kit is created and published by an independent attorney or paralegal Contributor. Purchasing a kit from a Contributor does not create an attorney-client relationship with that Contributor unless they have separately agreed to represent you. Legal document kits are informational products only and do not constitute legal representation.

4. Contributor Responsibility and Disclaimer

CONTRIBUTORS ARE SOLELY RESPONSIBLE FOR THEIR KITS. Each Contributor who publishes a legal document kit on Legal Kits Pro represents and warrants that they:

• Are duly licensed to practice law or work as a paralegal in the relevant jurisdiction(s)
• Have created the kit materials themselves or have proper authorization to publish them
• Are solely responsible for the accuracy, completeness, legality, and currency of all kit contents
• Will maintain professional liability insurance covering their published kits
• Agree to indemnify Legal Kits Pro from all claims arising from their kit contents

Legal Kits Pro makes NO warranties, representations, or guarantees regarding:

• The accuracy, completeness, or legal sufficiency of any legal document kit
• The qualifications, credentials, or licensure status of any Contributor
• Whether any kit complies with current laws or court requirements
• Whether any kit is appropriate or suitable for your specific legal matter
• The outcomes or results you may achieve by using any kit

• Prompt Injection: Attempting to override, circumvent, or manipulate the AI's system instructions
• Automated Abuse: Using automated scripts, bots, or tools to spam or overload the AI service
• Data Harvesting: Attempting to extract, reverse engineer, or systematically collect data from the AI system
• Illegal Content: Requesting, generating, or sharing content that violates any applicable laws
• Harmful Content: Requesting generation of content intended to harm, harass, threaten, or defame any person or entity
• Intellectual Property Violations: Requesting generation of copyrighted material or content that infringes on third-party rights
• Misinformation: Deliberately attempting to train or manipulate the AI to generate false or misleading information

3.3 User Responsibility and Liability for AI Abuse

YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH THE AI ASSISTANT. Legal Kits Pro reserves the right to:

• Monitor and log all AI assistant conversations for quality assurance and abuse prevention
• Immediately terminate access to the AI assistant for any user violating these Terms
• Report malicious activity to appropriate law enforcement authorities
• Pursue legal action and seek damages for any abuse causing harm to our systems, reputation, or business
• Block IP addresses, implement rate limiting, or take other technical measures to prevent abuse

You agree to indemnify and hold harmless Legal Kits Pro from any claims, damages, losses, or expenses (including attorney fees) arising from your abuse or misuse of the AI assistant.

3.4 Data Sharing and Privacy in AI Conversations

DO NOT share sensitive, confidential, or personally identifiable information through the AI chatbot. This includes but is not limited to:

• Passwords, API keys, or authentication credentials
• Social Security numbers, credit card numbers, or financial account information
• Protected health information (PHI) or medical records
• Proprietary source code or trade secrets
• Any information subject to confidentiality agreements

AI conversations may be processed by third-party AI providers (Anthropic, OpenAI) and are subject to their privacy policies. Legal Kits Pro is not responsible for how third-party AI providers handle your data.

7. Limitation of Liability

LEGAL KITS PRO SHALL NOT BE LIABLE FOR:

• Legal Outcomes: Any legal outcomes, court decisions, or consequences resulting from your use of any legal document kit purchased through the Platform
• Kit Content: Any errors, omissions, inaccuracies, or deficiencies in any legal document kit created by a Contributor
• Contributor Actions: Any acts, omissions, negligence, or professional malpractice by any Contributor
• Legal Malpractice: Any legal malpractice claims, disciplinary actions, or professional liability issues involving Contributors
• Financial Losses: Any financial losses, legal fees, court costs, or damages you incur in connection with any legal matter
• Consequential Damages: Any indirect, incidental, special, consequential, exemplary, or punitive damages, even if advised of the possibility of such damages

LEGAL KITS PRO'S TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO LEGAL KITS PRO (NOT THE CONTRIBUTOR) FOR PLATFORM FEES IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS LESS.

THE PLATFORM, ALL LEGAL DOCUMENT KITS, AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

8. User Indemnification

You agree to indemnify, defend, and hold harmless Legal Kits Pro, its officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorney fees and court costs) arising from or related to:

• Your Use of Kits: Your download, use, modification, filing, or reliance upon any legal document kit purchased through the Platform
• Legal Matters: Any legal proceedings, disputes, or matters in which you use or reference any materials obtained through the Platform
• Claims Against Contributors: Any claims you make against Contributors for legal malpractice, negligence, errors, or omissions in their kits
• Third-Party Claims: Any claims made by third parties arising from your legal matters or use of legal document kits
• Violations: Your violation of these Terms or any applicable laws
• Misuse: Your abuse or misuse of the Platform, AI assistant, or any services
• False Information: Any false, misleading, or fraudulent information you provide

This indemnification obligation survives termination of your account and continues indefinitely.

9. Florida Bar Compliance and Disclaimers

For Contributors who are Florida Bar members: Contributors are responsible for ensuring their kits, profiles, and descriptions comply with Florida Bar advertising rules, including Rules 4-7.12 through 4-7.21. Contributors must include required disclaimers as mandated by The Florida Bar for their specific advertisements and specialization claims.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Platform shall be resolved exclusively in the state or federal courts located in St. Johns County, Florida, and you consent to personal jurisdiction in such courts.

11. Modifications to Terms

We reserve the right to modify these Terms of Service at any time, at our sole discretion. Changes will be effective immediately upon posting to this Platform. Your continued use of the Platform following any modifications constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.
